Fragment umowy
1. Wraz z dostarczeniem Zamawiającemu dowolnych utworów bądź też ich części stworzonych w związku z realizacją niniejszej Umowy (w dalszej części również jako „Utwory”) Wykonawca, w ramach wynagrodzenia wskazanego w § 11 ust. 1 Umowy, przenosi na Zamawiającego, a Zamawiający nabywa na zasadach wyłączności autorskie prawa majątkowe oraz prawa zależne do nieograniczonego w czasie i zakresie, w tym terytorialnym, korzystania, wykonywania Utworów zależnych i rozporządzania Utworami lub wszelkimi innymi dziełami stworzonymi w związku z niniejszą Umową w dowolny sposób i w dowolnej ilości, w całości lub w części oraz do wszystkich celów, w tym (między innymi) dla potrzeb budowy, ukończenia, odbudowy, przebudowy, modyfikacji, naprawy, użytkowania, wynajmu, sprzedaży przedmiotu inwestycji lub jego dowolnej części w nieograniczonej liczbie egzemplarzy, a także udziela zezwolenia oraz udziela upoważnienia do wykonywania praw osobistych, a wraz z przeniesieniem praw autorskich Zamawiający nabywa prawo własności nośników tych praw.
2. Oprócz wyżej wspomnianych, przeniesienie praw autorskich, w ramach wynagrodzenia umownego, obejmuje ponadto wszelkie istniejące w dniu zawarcia niniejszej Umowy pola eksploatacji, w tym określone w art. 50 ustawy o prawie autorskim i prawach pokrewnych.
1. Along with supplying the Contracting Authority with any pieces of work or parts thereof created in connection with performance of this Agreement (hereinafter also referred to as the „Pieces of Work„), the Contractor, within the remuneration specified in section 11 item 1 of the Agreement, transfers to the Contracting Authority, and the Contracting Authority acquires, on an exclusive basis, author’s economic rights and subsidiary rights without limitation in time and scope, including territorial scope, to use, perform and dispose of dependent Pieces of Work or any other works created in connection with this Agreement in any manner and in any quantity, in whole or in part, and for all purposes, including (but not limited to) for the purpose of construction, completion, reconstruction, alteration, modification, repair, use, rental, sale of the subject matter of the investment or any part thereof in an unlimited number of copies, as well as grants permission and authorization to exercise moral rights, and with the transfer of copyrights, the Contracting Authority acquires ownership of the media of such rights.
2. Apart from the above-mentioned, transfer of copyrights, within the framework of the contractual remuneration, shall also include all fields of exploitation existing on the day of concluding this Agreement, including those specified in Art. 50 of the Copyright and Related Rights Act.
